TERMS & CONDITIONS Summary



UK, 18+ only. Giveaway Period 1: Tuesday 1st December 2020 at 11:00am to Friday 4th December 2020. Giveaway Period 2: Tuesday 8th December 2020 at 11:00am to Friday 11th December 2020. Internet connection and Twitter account required. First 10,000 individuals on each Giveaway to retweet the Too Good Not To Share entry tweet will be able to claim a free On The Go pack of Chocolate Digestives (containing 2 Chocolate Digestives) to be send to them or a friend.



Full Terms and Conditions



1. Information on how to enter forms part of the terms of entry. Entry into the McVitie’s Too Good Not To Share (“Giveaway”) is deemed acceptance of these terms and conditions. Eligibility to Enter

2. Entrants must be aged 18 or over at the time of entry or their entry may be deemed invalid. Entry is open to residents of the UK, Channel Islands or Isle of Man, excluding employees and the immediate families of United Biscuits (UK) Limited trading as pladis (the “Promoter”), their associated companies, their agents and anyone professionally connected with the Giveaway.

3. Internet connection and Twitter account required.



Giveaway Period



4. The Giveaway will occur over two periods; Tuesday 1st December 2020 at 11:00am closing on Friday 4th December 2020, and again on Tuesday 8th December 2020 at 11:00am closing on Friday 11th December 2020 (“Giveaway Period”). The Giveaway will run from 11:00am on the start date indicated until all unique URLs have been claimed or from 11:00am on the start date indicated until the closing date indicated for each Giveaway Period.

5. The Giveaway will be advertised on, but not limited to Twitter.



How to Enter



6. How to Enter:

Individuals can only enter the Giveaway via Twitter and will need a Twitter account. To join, the individual must retweet the entry tweet, which can be found either on the McVitie’s Twitter account (https://twitter.com/McVities) or discovered via another Twitter follower’s feed. The first 10,000 individuals (or Twitter handles) to retweet the entry tweet will then be eligible to claim the prize and will be sent a congratulations message with a unique URL link and instructions to claim a free On The Go pack of Chocolate Digestives – as the entry post suggests this URL link can be shared with someone else to claim or kept for yourself, however, it can only be used once. Those who tweet after the first 10,000 tweets will be sent a commiseration message. Both the congratulations and commiseration message will be visible only to the individual who tweeted via the Messages section on Twitter. The entrants must be following @McVities on Twitter to receive the message. Users may enter as many times as they wish but each twitter handle is only eligible to successfully claim the prize once. 7. Once the link within the message is clicked, they will be taken through to a McVitie’s Too Good Not To Share brand page . The individual will need to click the ‘Claim’ button at the bottom of that page, taking them to the next page to provide the full name and delivery address of the recipient. An email address will also be required at this time. The Terms and Conditions of the fulfillment partner of this Giveaway, will need to be accepted to proceed. Following the completion of this delivery, a marketing survey and follow-up marketing email will be sent to the email address provided. The individual will have the option to object to receiving the survey and marketing emails at the time they provide their personal details or with any communication thereafter. The unique URL can only be used once.

8. When claiming the prize, you will be required to provide certain information, such as you or your nominated recipient’s name and address. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. The Promoter shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information.

9. An entry must be made directly by the individual entering the Giveaway. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will be not be counted. If it becomes apparent that an individual is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that individual’s chances in the Giveaway in a way that is not consistent with the rules of the Giveaway, that individual’s entries will be disqualified and any entry will be void.

10. The Promoter and their agents have full discretion over the Giveaway, and any decision of the Promoter in all matters is final and binding and no correspondence will be entered into.

11. No responsibility can be taken for tweets which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to Twitter.

12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 13. By entering the free prize draw, all participants agree to give Twitter a complete release from all legal liability in connection with the free prize draw.

Prize Details



14. There will be a maximum of 20,000 On The Go Chocolate Digestives packets available, capped at 10,000 packets per Giveaway Period.

15. Entry is free. No purchase is necessary

16. The Prize is non-transferable.

17. If the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a Prize of equal or greater value.

18. The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the Giveaway result.

19. Personal information about the Winners will be shared with the Prize provider, and their agents, to the extent necessary for prizes to be delivered to the Prize Winner.

20. If a Winner does not provide proof of meeting the age restriction and other valid entry requirements of notification of winning, their Prize will be forfeited in full, and the Winner will have no further claim.

21. This Promotion is governed by English Law and participants submit to the exclusive jurisdiction of the English courts.

• We use very little personal data for our McVitie’s Too Good Not To Share Giveaway, but we need some to process your entry. We also need personal details to fulfil prizes or to respond to any enquiries you may have, to provide you with the optional survey, and the optional follow-up marketing information. This privacy notice explains what personal data we process and your rights over what we do with it.

• If you win then we'll contact you to provide a link where you, or the person you nominate as your winner, can claim the prize. We will need to collect the winner’s name, address and email, for delivery of the prize. Our processing of this personal data is necessary for the performance of the Promotion contract.

• We will use personal data to provide the prize, to send a follow-up marketing survey, and further marketing emails. You may object to receiving the survey and emails at the time you provide your personal data, or any time thereafter.

• We will need to share personal data with our partners only to operate the Promotion. Our Prize fulfilment, survey and marketing communications will be administered on our behalf by SoPost Ltd, The Core Bath Lane, Newcastle Helix, Newcastle Upon Tyne, United Kingdom, NE4 5TF. Other partners include IT service providers, delivery companies, and business partners who help us to ensure the proper administration of the Promotion and associated services.

• Should we need to transfer personal data outside of the EEA, we will ensure that appropriate legal and technical safeguards are in place.

• You can request copies of personal data about you including in portable electronic formats and, where appropriate, the rectification, erasure or restriction of processing of that personal data.
